Module AA - Identification of your proposed dealing and the proposed dealing area

This module is the first step in assessing whether native title impacts a proposed project. The questions below will help you fully identify the proposed dealing, including parcels of land and any waters (known as the ‘proposed dealing area’) that will be required.

You need to have a clearly identified proposed dealing area to complete the native title works procedure assessment.

How to complete this module

Identify the proposed dealing

You need to describe why you’re making this native title assessment when you identify your proposed dealing.

Here are some examples of proposed dealings:

  • granting tenure (for example, a lease)
  • constructing public works
  • compulsory acquisition of native title rights and interests
  • dedicating an area as road
  • dedicating an area as a reserve for a public purpose
  • renewing an existing permit, lease, licence or authority
  • granting a permit, licence or authority
  • granting a right to mine
  • granting a tenure that will permit the construction of works
  • making, amending or repealing legislation
  • preparing a management plan
  • undertaking management activities on a protected area.

Identify the land or waters affected

Once you’ve identified the proposed dealing, you’ll need to accurately identify the parcels of land and any waters involved. This is called the proposed dealing area.

In most cases, we determine how we address native title based on:

  • the current tenure of the proposed dealing area
  • whether the area is land or waters.

When you add the details of the land or waters involved in your dealing, you can identify the area using:

  • lot or plan details
  • the area’s current status
  • a locality description
  • a plan or map that you upload.

To identify your proposed dealing area, use these questions to guide you:

  • What is the lot-on-plan description?
  • Is the area over or in a river, creek, lake, ocean or sea?
  • What is its name (for example, the Pioneer River)?
  • Is the area within a reserve? What is the purpose of the reserve (for example, a recreational reserve)?
  • Is the proposed dealing within an area dedicated as road?
  • What is the current tenure of the land (for example, freehold, leasehold)?
  • Is the dealing over unallocated state land?
  • Do you need GPS coordinates (for example, for buoy moorings)?
