Land that has not been subjected to contamination nor a notifiable activity
If you have completed a search of the Environmental Management Register (EMR) and have identified land listed on the EMR that you believe has not been subjected to contamination nor a notifiable activity you can make an enquiry to the department.
You will find more information about how to make an enquiry by reading the information sheet numbered ESR/2025/7078 and called “Land listed on the Environmental Management Register (EMR) which has not been subjected to contamination nor a notifiable activity”.
You can submit an enquiry by completing form number ESR/2025/7077 and sending it to the department via email following the instructions on the form.
You will be asked to provide the following information (if available) to support your enquiry:
- Landowner details.
- Current street address and lot on plan details of the land.
- Current and historical title searches of the land (for each allotment).
- Current and historical survey plans of the land (for each allotment).
- A statement as to why you believe the land should not have been listed on the EMR.
- Any correspondence, letters, or historical records of the land history that support your enquiry.
- Copies of past notification(s) to the administrating authority regarding listing of the land.
- Copies of any environmental or investigation reports relevant to the land.
- Past development approvals, such as for reconfiguration of land or material change of use.
The supporting information should demonstrate the current and past condition and use of the land and provide evidence that the land should not have been listed on the EMR. The department will provide a response after consideration of the available information.
Do I have to be the landowner to make the enquiry?
Yes, only the landowner, or their appointed legal representative, can make an enquiry regarding land listed on the EMR.
