Exempt waste
Under the Waste Reduction and Recycling Act 2011 (the Waste Act), some waste may be exempt from the waste levy. This includes:
- Disaster management and serious local event waste
- Approved exempt waste (by application only)
- Other specific exempt wastes (automatically exempt)
- Other declared wastes (exceptional circumstances)
It is important to note that despite a waste being exempt from the levy, a landfill operator may charge a gate fee to receive and manage the waste. This fee is separate to the waste levy and is set by the landfill operator.
Landfill operator obligations
Despite exemption from the levy, the landfill operator must still comply with other waste levy obligations, such as remitting levy on all waste received and disposed of at the site, installing weighbridges, and reporting to the Department of the Environment, Tourism, Science and Innovation. The relevant exempt waste number must be used in data recording and waste data returns. See information for landfill operators for details.
Disaster management and serious local event waste
Exempt waste includes wastes generated as a result of a disaster (e.g. flooding or bushfire) or a serious local event.
These exemptions are issued following the Queensland Government declaring a disaster situation or a local government notifying the department of serious local event.

Approved exempt waste (by application)
Types of waste for which an application can be made
A person may apply to the department for approval of certain waste as exempt waste. The application may be about only one of the following types of waste:
- waste received as part of charity donations that cannot practicably be re-used, recycled or sold
- litter and illegally dumped waste which is collected as part of an organised community clean up activity
- earth contaminated with a hazardous contaminant from land listed on the environmental management register or contaminated land register
- waste necessary for the operation of the leviable waste disposal site, such as for building infrastructure, temporary or daily cover, progressive or final capping, batter construction, profiling and site rehabilitation.
In addition:
- The chief executive of the department that administers the Biosecurity Act 2014 may make an application about biosecurity waste.
- The chief executive of a local government area may make an application about serious local event waste (to extend the exemption period).
How to apply for waste levy exemption
A person may apply to the department for a waste levy exemption by submitting applications in the new Queensland Waste Data System (QWDS) and if you have any issues or if QWDS is unavailable, please contact us at wastelevyapps@detsi.qld.gov.au. All the information requested in QWDS, and any relevant fees, must be provided.
Each application may only be for one of the exempt waste types. If you are seeking an exemption for multiple wastes, a separate application must be submitted for each waste type.
The application process and timeframes for assessing waste levy exemptions are outlined below.
- Application is submitted to the department
- The department will consider the application and within 28 days either:
- make a decision
or - ask for more information.
- make a decision
- If the department asks for more information, the applicant will be given a reasonable timeframe to provide this and the decision will be made within 28 days of receiving the information.
- Within 5 business days of making the decision, the department will:
- if approved: issue a notice including an exemption certificate and unique exempt waste number
or - if refused: issue an information notice about the decision.
- if approved: issue a notice including an exemption certificate and unique exempt waste number
It is important that all relevant supporting information is provided when making an application. An application is taken as withdrawn if an applicant does not respond to an information request within the timeframe stated. Further, applications where a decision is not made within 28 days of receiving the application or further information are considered to be refused.

How to submit an exemption application
Welcome to the quick reference video on How to submit an exemption application in the Queensland Waste Data System, or QWDS for short.
Upon completion of this module, you will be able to submit your exemption application.
If you’re new to exemption application submissions and exemption approvals, we recommend using the Submitting and Managing Exemption Applications and Approved Exemptions user guide which contains more detailed steps. This user guide can be found on the Department’s website by searching for ‘QWDS Training Materials.’
Now let’s begin on the QWDS Home Page.
Under the Actions section on the left side of your screen, select Apply for a New Approval to display the QWDS Application screen.
The Getting Started screen automatically displays your role, either a Waste Operator or Exemption Applicant.
Click the Select Application Type dropdown menu and choose the type of application you wish to submit. For this example, we will choose Contaminated earth.
Once selected, new information displays on the screen relating to your selection. including the application description and fee.
You have the option to Cancel your application if you do not wish to progress, however, in this case we will click Next.
In the Site Details screen, your Application Reference number (<insert application reference>) is created once you reach the Site Details screen.
Click the Select Site Detail dropdown menu to select the waste disposal sites related to your application.
You can choose one or more sites by clicking each option and, once you’ve completed your selection, click outside the dropdown menu to see the list of sites under Selected Sites. ACME Landfill has been chosen in this example.
You also have the option to Save and Close if you wish to return and complete this application later or Withdraw Application to remove your application completely.
However, we will click Next to continue.
In the Contact Details screen, select who will be contacted about this application using the dropdown menu.
You can only choose one option which will display once selected, and we’ve selected Joe Citizen in this example.
If a name is not showing in the list, you have the option to click the ‘here’ link which will take you to the Contacts page where you can add new contact details to display in the dropdown menu.
Please click Next.
The Application Details screen contains questions required for your application which will change depending on your application type.
Under Section 1: Project Description, add a brief description of your waste project.
In this example, we’re transferring contaminated earth from Acme Construction site to Acme Landfill.
Under Section 2: Eligibility Criteria, respond to each question to learn whether your application will be eligible for consideration.
Some responses will also prompt you to enter or attach additional information and you are required to add the site details for where the waste is coming from. In this example, we’ll add in that the contaminated earth is coming from 1 Fake Street, Suburbia for the street address. And the real property description as Lot 1 on Plan 12345 and the Contaminated land register identifier of 1234567.
Also we will add in that we are describing earth that has been contaminated by underground fuel tanks and dry-cleaning chemicals and providing justification about why it should go to landfill.
Under Section 3, you are required to select from a list of options that indicate the specific circumstances that apply to your project. One or multiple options can be selected and further questions may display based on your responses.
For a contaminated earth application, the specific circumstances relate to section 10 of the Waste Reduction and Recycling Regulation 2023.
For this example, we will check the Historical contamination box which asks us to respond to question 3.1: Was the earth contaminated before 1 January 1992?
Then we’ll select Yes and provide details in the description field.
We will also need to select Not Applicable for non-relevant sections 3.2 to 3.4.
Section 4 asks you to enter the exemption period sought for the exemption application and can be typed in using the day month year format or selected from the calendar pop-up.
We’ll enter an exemption period between 1st September 2025 to 30 September 2025 in this example and add in the justification for this period.
In Section 5, enter the quantity of exempt waste in tonnes and note that contingencies will not be considered when calculating tonnes requested to be exempt waste.
For this example, we’ve entered 100 tonnes and stated that a qualified surveyor provided these calculations and are supported in the attached documentation.
Click Next to save your application details and move to the next screen.
The next screen is a dedicated Documents screen to upload all supporting documents for your exemption application, including documents you’ve indicated will be provided using checkboxes in the Application Details screen.
Please note, it is the applicant’s responsibility to ensure they upload all documents they’ve indicated they will provide. Any document not provided may result in a request for this document and potentially cause delays.
To attach files, simply click the Upload button to browse files on your computer. Once located, double-click the file and give it a name in the Document Name field. In this example, we’ve added the Soil Analysis Laboratory Report that was checked in the Application Details screen.
You’re able to upload up 13 documents up to 50 megabytes each in size and once you’ve uploaded all your files, click Next.
The Review screen provides you with the opportunity to check your exemption application on one page before submitting.
Error messages are also displayed at the top of the screen to indicate any sections where you’ve missed any mandatory questions or not provided complete or accurate responses. Below the error messages, screen links are provided to direct you to each screen that contains errors.
In this example, there are no error messages.
We’ll now scroll through and review the information added in the previous screens.
Once you’re happy with the information you have provided in the Review screen, click Next.
In the Declaration screen, check the Tick to Accept box to declare the information you have provided is true and correct and understand that it is an offence to knowingly give information that is false, misleading or incomplete.
Then click Submit.
In the Fee Details screen, review the Invoice Item Details including the Total Amount Payable, and if you’re happy, click Next.
In the Application Fee screen, you have two choices: one, enter your Mastercard or Visa details then click Pay Now or two, click Pay Later to defer the payment at a later time.
If you click Pay Later, a pop-up message displays asking you to confirm whether you’re happy for the application to be saved and allow you to make a payment at a later time.
Paying later will update your exemption application status to Awaiting Payment and is yet to be submitted to the Department for assessment.
Under the Application Invoices link in the Record section, a new invoice record will also display with the Status of Pending. You can go to your My Incomplete Actions section to continue your application.
However, in this case we will provide our credit card details and click Pay Now.
The next screen confirms whether your payment has been successful and provides you with an invoice reference.
If your payment is unsuccessful, a message displays asking you to submit valid Mastercard or Visa details.
In this case, our payment has been successful and we will click Submit.
Finally, a message lets you know that your application has been successfully submitted for assessment.
Click Finish to return to your Applications page.

How to view and amend an approved exemption
Welcome to the quick reference video on How to view and amend an approved exemption in the Queensland Waste Data System, or QWDS for short.
Upon completion of this module, you will be able to: View approved exemption, and, Amend an approved exemption.

Now let’s begin on the QWDS Home Page.
Under the Records menu, click Applications and then search for your Lodged application using the Status dropdown field and click the Lodgement Date column to sort the most recent applications at the top.
Once an exemption application status has changed from Draft to Lodged, it has been received and is ready to be assessed.
Once the exemption application has been assessed and finalised, the status will update to Closed in the Application screen and you will be notified of the decision.
If approved, the notification will also include an exemption reference number.
To search for your approved exemption, click Approvals under the Records section and click the Start Date column to sort by your exemption start date.
To see more detail or amend your approved exemption, click the Reference Number link to display the Approval Reference screen.
The Summary tab displays General Information, such as exemption status, shown as Active in this example, and usage, including the quantity of exempt waste, remaining tonnes and remaining tonnes percentage. The Remaining Tonnes and Remaining Tonnes percentage fields display the remaining quantity of exempt waste allowed for your approved exemption and will update each time the waste operator submits their monthly waste data within your approved exemption period.
Now click the Documents tab to display documents attached to your approval, such as your exemption approval.
And click Approval History to display previous versions of your exemption approvals. In this case, no history displays as this is a new approved exemption.
To amend an approved exemption, click the Related Actions tab and then click the Start Amendment link.
Amending an approved exemption uses the similar screens and steps to submit a new exemption application.
In this case, the Application Reference: Getting Started screen already populates Your Role and Application Type you’re amending, so simply click Next.
In the Site Details screen, select the waste disposal sites from the dropdown menu. In this example, we’ll select Acme Landfill.
Then click Next.
In the Contact Details screen, select the contact from the dropdown menu. In this example, we’re selecting Joe Citizen.
Then click Next.
In the Application Details screen, provide details of your amendment request. In this example, we’re requesting an extension of the approved exemption period to 28 February 2026 due to weather delays.
Then click Next.
In the Documents screen, attach files by clicking the Upload button to browse files on your computer.
Once the file is located, double-click the file to upload and give it a name in the Document Name field. In this example, we’re uploading the Updated Waste Project Plan.
When all documents have been uploaded, click Next.
The Review screen provides you with the opportunity to check your amendment application on one page before submitting.
Error messages are also displayed at the top of the screen to indicate any sections where you’ve missed any mandatory questions or not provided complete or accurate responses. Below the error messages, screen links are provided to direct you to each screen that contains errors.
In this case, we’re happy with the information provided in the Review screen and will click Next.
In the Declaration screen, check the Tick to Accept box if you agree with the declaration.
Then click Submit.

If you’re happy with the details and amount, click Next.

In the Applications screen, you can see a new application record has been created with an Application Type of Amend and Application Status as Lodged.
Once the amendment application has been assessed and finalised, the status will update to Closed in the Application screen and you will be notified of the decision.
If approved, the notification will also include an exemption reference number.
In this case, our exemption application has been successful.
To search for your amended approved exemption, click Approvals under the Records section and click the Start Date column to sort by your exemption start date.
To see more detail or further amend your approved exemption, click the Reference Number link to display the Approval Reference screen.
In the next screen, the Approval Reference number will be updated with version 2.
Under the Summary tab, the General Information section displays more details of the amended approval, including the updated exemption end date of the 28 February 2026.
Click Documents to display documents attached to your approval such as your amended exemption approval. You can check the Download box to save a copy to your local drives.
And click Approval History to display previous versions of your exemption approvals. For example, the Version column displays the number one and the status column displays Superseded to indicate it was the original application.

Disposing approved exempt waste to landfill
The approval holder must do the following in order to receive the levy exemption when disposing the exempt waste to the approved landfill:
- present the exemption certificate and unique exempt waste number (included on the exemption certificate) to the landfill operator
- comply with any conditions of the exemption certificate.
What happens if my application is approved?
If the application is approved, the department will issue you a notice of approval that details:
- the waste that has been approved as exempt waste
- the period of the approval
- any conditions of the approval (e.g. specific landfills the waste can be disposed at and the amount of exempt waste that can be disposed of).
The notice will include an exemption certificate and unique exempt waste number.
What if my application is refused?
If the application is refused, the department will issue you an information notice that includes the reason for the decision and any relevant information on review rights.
When delivering the waste to a landfill for disposal, the waste levy will apply.
Other specific exempt wastes
Some waste types are automatically exempt from the levy through the Waste Act. An application for these types of wastes is not required. This includes:
- certain types of lawfully managed and transported asbestos waste
- dredge spoil if, for dredge spoil that is acid sulphate soil, the dredge spoil has been treated in accordance with best practice environmental management for the treatment and management of acid sulphate soils
- clean earth (until 1 July 2023)
- litter and illegally dumped waste collected by or for the State, a local government, or a forestry plantation licensee
- other waste prescribed by regulation
- other declared wastes (exceptional circumstances).
When disposing of these types of exempt wastes to landfill, you must provide evidence to the landfill operator that the waste meets the definition of exempt waste in section 26 of the Waste Act.
Asbestos waste
If certain criteria are met, asbestos waste may be exempt from the levy. Read the information sheet 487 KB) for guidance on how the waste levy applies to the disposal of asbestos waste.
Prescribed by regulation
The following waste is exempt from the waste levy under the Waste Reduction and Recycling Regulation 2011:
- waste water that meets the water quality for irrigation and general water use requirements stated in the guideline for water quality (PDF, 1.83MB), chapter 4.2; or
- waste water that meets the water quality for livestock drinking water requirements stated in the guideline for water quality (PDF, 1.83MB), chapter 4.3; or
- alum sludge or other residuals produced as a result of a drinking water treatment process (until 30 June 2029); or
- waste generated in Norfolk Island and imported by the Norfolk Island Regional Council into Queensland (until 30 June 2030); or
- coal power station ash; or
- residue waste from
- a glass beneficiation plant; or
- a material recovery facility.
When disposing of these types of exempt wastes to landfill, you must provide evidence to the landfill operator that the waste meets the criteria in in section 8 of the Waste Reduction and Recycling Regulation 2023.
Other declared wastes (exceptional circumstances)
The department may declare a waste to be exempt in exceptional circumstances. These exemptions are granted at the department’s discretion in accordance with section 35 of the Waste Act. Conditions may be imposed on any exemption declaration made.
Information about the declaration, including the exempt waste number, will be provided to the relevant local government and waste disposal site.
When disposing of waste declared exempt by the department due to exceptional circumstances, you must:
- provide the exempt waste number issued for the declaration to the landfill operator
- comply with any conditions of the declaration.
Declaration of exempt waste – coloured sand products containing asbestos
The department has declared that waste coloured sand products containing asbestos disposed to landfill is exempt waste, subject to any conditions and limitations (as per s35(3) of the Act) included in this declaration.
The Declaration of exempt waste – coloured sand containing asbestos 201.2 KB) details this exempt waste and conditions that apply.
Definitions
coloured sand products containing asbestos means all products the subject of an Australian Competition and Consumer Commission Product Safety issued national recall notice:
- Educational Colours rainbow sand and Kadink sand (1.3kg);
- Creatistics coloured sand (1kg);
- Kadink Decorative sand 10g 6 pack;
- Active Sandtub 14 piece Sand Castle Building Set; and
- Blue, Green and Pink Magic Sand.
The following conditions apply to this declaration –
- Coloured sand products containing asbestos is exempt waste under this declaration from the date of this declaration to 18 February 2026 inclusive.
- This declaration does not apply to other waste mixed with coloured sand products containing asbestos.
- This declaration applies only to coloured sand products containing asbestos in Queensland.
- This declaration only relates to exemption from the waste levy. It does not affect requirements or conditions of any environmental authority or any other approval, permit or obligation under the Environmental Protection Act 1994, the Waste Reduction and Recycling Act 2011 or any other Act.
Declaration of exempt waste – waste donated to a Recognised Religious Organisation conducting a Charitable Recycling Activity
The department has declared that waste that has been donated to a recognised religious organisation but that cannot be practicably re-used, recycled or sold is declared to be exempt waste.
The Declaration of exempt waste 150.8 KB) details this exempt waste and conditions that apply.
The conditions of the declaration are:
- an organisation seeking to operate under this declaration must request and obtain approval from the department.
- in requesting approval the organisation must provide:
- information demonstrating the organisation:
- meets the definition of recognised religious organisation; and
- meets those parts of the definition of charitable recycling entity under sections 28(5)(a) and 28(5)(d) of the Act
- information as required in the approved QWDS application ‘Approval of waste as exempt waste—charitable recycling entity’, other than information relevant to section 28(5)(b) and 28(5)(c) of the Act.
- information demonstrating the organisation:
- If a request under this declaration is approved and a waste levy exemption issued, it must be presented each time the exempt waste is delivered to a waste disposal facility.
- The waste under this declaration is exempt from the date of declaration until 30 June 2027.
- A waste levy exemption issued under this declaration may be cancelled or amended for any of the reasons outlined in section 34 of the Act.
Declaration of exempt waste – Northern Iron and Brass Foundry
The department has declared used foundry sand generated by the Northern Iron and Brass Foundry as exempt waste from the waste levy from the date of publication until 31 December 2028.
The Declaration of exempt waste – Northern Iron and Brass Foundry 62.3 KB) details this exempt waste and conditions that apply.
The conditions of the declarations are:
- foundry sand is exempt waste under this declaration from the date of this declaration to 31 December 2028 inclusive.
- this declaration does not apply to other waste mixed with foundry sand.
- this declaration applies only to foundry sand generated by Northern Iron and Brass Foundry.
- this declaration only relates to exemption from the waste levy. It does not affect requirements or conditions of any environmental authority or any other approval, permit or obligation under the Environmental Protection Act 1994, the Waste Reduction and Recycling Act 2011, or any other legislation.
Declaration of exempt waste – Yarrabah Aboriginal Shire Council (sewage treatment plant sludge removal works)
The department has declared waste removed from the Yarrabah Aboriginal Shire Council sewage treatment plant as exempt from the waste levy from 11 December 2024 to 31 December 2025 inclusive.
The conditions of the declaration are:
- waste declared to be exempt under this declaration is limited to sewage sludge waste (biosolids) removed from the Yarrabah Aboriginal Shire Council sewage treatment plant, located at King Beach Road, Yarrabah, QLD 4871, as part of sewage treatment plant sludge removal works
- if waste declared to be exempt under this declaration is to be used for on-site operational purposes, the waste must meet all relevant requirements or limits for the waste types approved under 220043OSOP for the waste disposal site: Remondis – Springmount Waste Management Facility (C108410)
- if waste declared to be exempt under this declaration is to be disposed, the waste must meet all relevant conditions and limits within environmental authority BRID00026 for the waste disposal site: Remondis – Springmount Waste Management Facility (C108410)
- the amount of waste exempted under this declaration is limited to a total of 900 tonnes.
Declaration of exempt waste – Yarrabah Aboriginal Shire Council (Pre-cyclone season clean up)
The department has declared waste removed by or for Yarrabah Aboriginal Shire Council as exempt from the waste levy from 1 December 2025 to 31 March 2026 inclusive.
The conditions of the declaration are:
- The maximum weight of exempt waste must not exceed 200 tonnes over the exempt waste approval exemption period.
- Waste included under this exemption is limited to waste disposed as part of severe weather season preparations including, for example, green waste and other bulky items that may cause hazardous debris in the event of severe weather. Severe weather includes strong winds, cyclones, heavy rainfall, and flooding.
- Waste exempted under this declaration cannot be mixed with other waste when delivered to the waste disposal site.
- Final disposal of waste included under this exemption must meet the conditions of the environmental authority for the waste disposal site.
- The waste disposal site is Remondis – Springmount Waste Management Facility (C108410)
Declaration of exempt waste – Cairns Regional Council, Queensland
The department has declared waste removed from the Cairns Regional Council, Queensland as exempt from the waste levy from 1 July 2025 to 30 June 2026 inclusive.
The conditions of the declaration are:
- Waste declared to be exempt under this declaration is limited to municipal solid waste that is collected by Cairns Regional Council in its respective local government area and removed from the Veolia Recycling and Recovery (Regional Queensland) Pty Ltd facility, located at 35–51 Lyons Street, Portsmith QLD 4870.
- Municipal solid waste is exempt waste only if it would have been destined for processing at the Advanced Resource Recovery Facility, Portsmith, during the period of the exemption.
- Waste is exempt waste only if it is transported by Cairns Regional Council or Veolia Recycling and Recovery (Regional Queensland) Pty Ltd, or by contractors on behalf of both entities.
- Cairns Regional Council must provide the administering authority a report within one month after the end date of the exemption, which contains details of each transaction of waste delivered to the waste disposal site authorised under this declaration.
Declaration of exempt waste – Mareeba Shire Council, Queensland
The department has declared waste removed from the Mareeba Shire Council, Queensland as exempt from the waste levy from 1 July 2025 to 30 June 2026 inclusive.
The conditions of the declaration are:
- Waste declared to be exempt under this declaration is limited to municipal solid waste that is collected by Mareeba Shire Council in its respective local government area.
- Municipal solid waste is exempt waste only if it would have been destined for processing at the Advanced Resource Recovery Facility, Portsmith, during the period of the exemption.
- Waste is exempt waste only if it is transported by Mareeba Shire Council or its contractors.
- Mareeba Shire Council must provide the administering authority a report within one month after the end date of the exemption, which contains details of each transaction of waste delivered to the waste disposal site authorised under this declaration.
Declaration of exempt waste – Douglas Shire Council, Queensland
The department has declared waste removed from the Douglas Shire Council, Queensland as exempt from the waste levy from 1 July 2025 to 30 June 2026 inclusive.
The conditions of the declaration are:
- Waste declared to be exempt under this declaration is limited to municipal solid waste that is collected by Douglas Shire Council in its respective local government area and removed from the Veolia Recycling and Recovery (Regional Queensland) Pty Ltd facility, located at 35–51 Lyons Street, Portsmith QLD 4870.
- Municipal solid waste is exempt waste only if it would have been destined for processing at the Advanced Resource Recovery Facility, Portsmith, during the period of the exemption.
- Waste is exempt waste only if it is transported by Douglas Shire Council or Veolia Recycling and Recovery (Regional Queensland) Pty Ltd, or by contractors on behalf of both entities.
- Douglas Shire Council must provide the administering authority a report within one month after the end date of the exemption, which contains details of each transaction of waste delivered to the waste disposal site authorised under this declaration.
Declaration of exempt waste – Mount Isa City Council, Queensland
The department has declared waste removed from the Sewage treatment plant in Mount Isa City Council, Queensland as exempt from the waste levy from 5 December 2025 to 30 June 2027 inclusive.
The conditions of the declaration are:
- Waste declared to be exempt under this declaration is limited to municipal solid waste that is collected by Douglas Shire Council in its respective local government
- The waste disposal site operator must use the exempt waste number in data recording and waste data returns.
- The maximum weight of exempt waste must not exceed 4,500 tonnes throughout the exempt waste approval exemption period.
- Waste included under this declaration is limited to sewage sludge waste removed from the Mount Isa City Council wastewater treatment plant, located at 1 Treatment Plant Road, Mount Isa, QLD 4825, as part of sewage treatment plant sludge removal works.
- Waste exempted under this declaration cannot be mixed with other waste when delivered to the waste disposal site.
- Final disposal of waste included under this exemption must meet the conditions of the environmental authority for the waste disposal site.
