How to request a review

You can only request a review of an appointment of a guardian or administrator in certain circumstances.

To request a review, you must complete a form and lodge it with QCAT.

The application may be made by any ‘interested person’ for the adult. This includes family members, close friends, professionals, or anyone with a sufficient and genuine concern for the rights and interests of the adult.

The adult subject to the order can also apply for a review.

When an appointment is reviewed

QCAT must review the appointment of a guardian or administrator at the time specified in the QCAT order.

Usually, QCAT must review the appointment of a guardian or administrator at least every 5 years. This does not apply where the Public Trustee or a trustee company is the appointed administrator.

QCAT may also review the appointment of a guardian or administrator if it becomes aware of a change in the adult’s circumstances, or other new information that may affect the appointment.

QCAT may conduct the review in the way it considers appropriate.

At the end of the review, QCAT must revoke the order unless it is satisfied that it would make an appointment if a new application were made.

If there are reasons why the order should continue, QCAT can continue the order, or change the order. This may include changing the terms of the order, removing a guardian or administrator, or appointing a new guardian or administrator.

When an appointment might end

The QCAT order appointing the guardian or administrator may say when the appointment ends.

An appointment will also automatically end if the adult subject to the order dies.

If there is a change in circumstances which mean that an appointment is no longer needed, QCAT can review the appointment and change or revoke the order.
