In some situations, you can apply to get an exception to the rules for changing names.

In short

The Registry of Births, Deaths and Marriages may approve a name change if you don't meet the rules. This is called an exception.

You need to submit the completed request exception to rules form and supporting documents with your change of name application.

What you should know

To request an exception you must:

  • complete a request exception to the rules form
  • provide evidence to support  your request
  • submit the request form and supporting documents together with your change of name application.

If you are applying for an exception for yourself and your child, you must complete a separate form for each application.

Who can use this service

You can request an exception to the rules if:
Correct. you can provide a good reason of why you or your child cannot meet an eligibility or residency requirements and
Correct. you can provide evidence to support your circumstances.
Don't use this service if:
Incorrect.yyyou were born in another state or territory, and you applied for a change of name there
Instead, contact the registry office in that state or territory.
Incorrect.you are unable to provide evidence or a good reason for not meeting a change of name eligibility or requirement.

How to request an exception to the rules

The documents you need to provide will depend on why you are asking for an exception.

How long it takes

A change of name application will take longer if you apply for an exception, even if you pay for urgent processing.

Standard application: 10 business days

Urgent application: 3 business days

Applications missing any information or documents will take longer.

Allow extra time for public holidays.

How much it costs

There is no extra fee to apply for an exception to the rules.

If your request is not approved, your name change application will be cancelled.

You will not receive a refund if:

  • your application is refused
  • you cancel the application after we have reviewed it.
